Product Sales Terms & Conditions
Product sales only. Effective 22 October 2026.
1. Who you are buying from
These terms apply to goods sold through the Birmingham Floors shop and to product-only orders agreed by telephone, email or WhatsApp. The legal seller is BEO Pro Group Ltd, registered office and correspondence address 11 Flackwell Road, Erdington, Birmingham, B23 5ES, United Kingdom. Registered in England and Wales, company number 12225251. VAT registration number GB 335963867. Contact: contact@birminghamfloors.co.uk or 07766 660732.
Installation, surveys, subfloor preparation and repair work are covered by a separate written quotation and service terms. Buying materials does not include installation. For goods purchases these Product Sales Terms replace conflicting product-sale provisions in our service terms and earlier returns policy. Your statutory rights are unaffected.
2. Products and suitability
Check the product, pack size, quantity and specification before ordering. A complete ARDITEX NA unit includes one powder bag and its matching latex bottle, as described in the listing. Photos illustrate the product; packaging may change, but goods must match their description. We will not substitute a different product without your agreement.
Follow the current manufacturer’s technical and safety guidance, including substrate preparation, moisture testing, storage, mixing, coverage and application limits. Tell us before ordering if you need a product for a particular purpose. Our responsibilities for goods being of satisfactory quality, as described and fit for a purpose made known to us remain in place.
Coverage calculators are estimates based on the stated coverage and average depth. They round up to complete units; any selected extra allowance is shown separately. Uneven floors and site conditions can increase usage. A calculator is not a site survey or installation specification.
3. Prices, VAT and payment
Consumer-facing shop prices include VAT where chargeable. Any separately quoted trade price excluding VAT will clearly show the VAT and total payable before you order. Delivery charges, where applicable, are additional and must be disclosed before purchase.
A price marked “for collection” covers the goods for collection only. The current ARDITEX NA collection offer is £40 including VAT per complete unit; the price shown and accepted for your order is the agreed price. Installation and delivery are not included in that collection price.
Goods must be paid for in full before release or dispatch unless we have agreed credit terms in writing. Installation credit terms do not automatically apply to shop purchases.
4. Ordering and acceptance
Check your order details before submitting. An automatic order-received email acknowledges receipt; acceptance takes place when we expressly confirm acceptance or confirm that the goods are dispatched or ready for collection. We will promptly advise of stock shortages or pricing errors before acceptance, explain the options and refund any payment if we cannot accept the order. Once accepted, we will not increase the agreed price without your consent. We provide the order details and applicable terms by email or another durable format.
5. Collection and delivery
Collection is by prior arrangement after we confirm that the order is ready. We will confirm the collection location and appointment. Bring your order reference and a suitable vehicle. Please check quantities and visible condition at handover and report issues promptly; this does not shorten your legal rights.
Delivery is available only where offered and agreed. Delivery is to UK mainland addresses within the service offered; Highlands, remote locations and other restricted destinations must be checked with us before ordering. The charge, delivery arrangements and any unloading requirements must be agreed before purchase. Goods will be delivered without undue delay and within 30 days unless another period is agreed.
For consumers, risk passes when you or your nominated recipient takes physical possession, including collection. If you independently appoint a carrier we did not offer, risk passes when that carrier receives the goods. Ownership passes on full payment. If a collection appointment cannot be kept, contact us to rearrange. We do not automatically impose a service-job cancellation fee on goods orders.
6. Consumer cancellation: online, telephone and WhatsApp orders
If you buy as a consumer under a distance contract, you may cancel without giving a reason from the time the contract is made until 14 days after the day you receive or collect the goods. For one order delivered separately, the period normally runs from receipt of the last item. Collecting an order does not remove distance-contract rights where the contract was concluded online or remotely.
Tell us clearly by email, post, telephone or WhatsApp that you wish to cancel, giving your name and order reference. You may use the form below but do not have to. Return the goods within 14 days after telling us. Contact us for return arrangements; arranging the return is not a requirement for us to accept a valid cancellation.
You pay the direct cost of a change-of-mind return. Where goods cannot normally be returned by post, we will disclose a reasonable estimated return cost before the order is placed. Do not send heavy goods without suitable packaging and transport arrangements.
For cancellation of a whole order, we refund the goods and the least expensive standard outbound delivery we offered. Extra charges for a premium delivery option are not refundable. We refund using the original payment method unless you agree otherwise, without a refund fee, within 14 days of being told of cancellation. Unless we have offered to collect, we may withhold reimbursement until we receive the goods or evidence that you sent them back, whichever is earlier.
You may inspect goods as you reasonably could in a shop. We may deduct only a lawful reduction in value caused by handling beyond what is needed to establish their nature, characteristics and functioning. Opening, mixing or using compound can reduce its value substantially; opened packaging alone does not automatically remove cancellation rights. No automatic restocking charge applies to statutory consumer cancellation.
Goods genuinely made to your specification or clearly personalised may be exempt from change-of-mind cancellation, where the legal exception applies and we explain it before purchase. A standard item ordered from a supplier is not automatically exempt. An ordinary purchase concluded in person has no automatic change-of-mind return right unless agreed, but faulty-goods rights still apply.
7. Faulty, damaged or incorrect goods
Contact us with your order details, the problem and, where useful, photographs and batch information. Stop using suspected faulty goods where reasonable and keep them available for inspection. Please report delivery damage promptly; failure to report it within a short fixed period does not remove consumer rights.
Consumers generally have a 30-day short-term right to reject goods that are faulty, not as described or otherwise fail the Consumer Rights Act 2015 requirements. After that, repair or replacement and, where the law provides, a price reduction or final rejection may apply. We bear reasonable necessary return costs for faulty or incorrect goods. Original packaging is not a condition of statutory remedies. Manufacturer warranties are additional and do not replace your rights against us.
8. Trade customers
A trade customer buys wholly or mainly for business purposes. Statutory consumer cooling-off rights do not apply to business purchases. Change-of-mind trade returns require our written agreement; any return charge must be agreed before the return. This does not remove rights relating to faulty or misdescribed goods under applicable law. Credit is available only by prior written agreement; otherwise full payment is due before release.
9. Responsibility, complaints and law
We are responsible for foreseeable loss caused by our breach of contract or failure to use reasonable care. We do not exclude liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be excluded. Consumer rights cannot be excluded by these terms. We are not responsible for damage caused solely by misuse or storage or installation contrary to instructions; this does not excuse a defect or our own breach.
Send complaints to the contact details above. We will investigate and explain our proposed resolution. These terms are governed by English law. Consumers retain mandatory protections and rights to bring proceedings in the courts available to them in their part of the UK. Changes apply to future orders only, not contracts already accepted.
